How Long Do You Have to File a Car Accident Lawsuit in Georgia?

Georgia’s Two-Year Statute of Limitations
O.C.G.A. Section 9-3-33 provides two years from the accident date for personal injury. For wrongful death, also two years from the date of death. For property damage only, four years under O.C.G.A. Section 9-3-30.
Exceptions
- Minors: Tolled until age 18, giving until age 20 to file
- Mental incapacity: Tolled during incapacity
- Government entities: Shorter notice requirements. Municipal claims require ante litem notice within 6 months under O.C.G.A. Section 36-33-5
- Fraudulent concealment: If the defendant hid the cause of injury
