This page describes how Wetherington Law Firm, P.C. uses SMS text messaging to communicate with clients about active legal matters, the consent process we use, and your rights to opt out at any time. This page supplements, and should be read together with, our Privacy Policy and Terms of Service.

Program Description and Opt-In Call to Action

By providing your mobile number to Wetherington Law Firm, P.C. and agreeing to receive text messages from us, you authorize us to send you SMS text messages regarding your legal matter, including appointment reminders, document requests, court-date notifications, hearing reminders, settlement updates, and case status updates. Message and data rates may apply. Message frequency varies based on the activity in your case. Reply STOP at any time to opt out of text messages from the firm. Reply HELP for help. You may also opt out by emailing matt@wfirm.com or by calling our office at (404) 738-5349.

We obtain your express written consent for SMS communication at the time you sign our representation agreement, or through a separate written or electronic consent form. We only send text messages to clients with whom we have an active attorney-client relationship, and only for purposes related to your representation. We do not use SMS for promotional, marketing, or solicitation messages, and we do not send text messages to non-clients.

How Consent Is Collected

Mobile numbers used for SMS communication are collected in one of the following ways:

  • You provide your mobile number on our intake form or representation agreement and check or sign a box affirming that you consent to receive text messages from the firm regarding your matter.
  • You provide your mobile number directly to an attorney or staff member and verbally or in writing authorize us to text you about your case.
  • You reply to a written consent request we send by email or letter.

Consent to receive SMS text messages is not a condition of representation. You may decline SMS communication at any time and continue to receive case updates by phone call, email, or postal mail without penalty.

Message Frequency

Message frequency varies based on the activity in your case. In a typical month you may receive between 1 and 10 messages from the firm. During periods of heightened activity, such as the week before a deposition, mediation, or trial, you may receive additional messages. We do not send recurring marketing messages.

Charges, Carriers, and Devices

Message and data rates may apply depending on your mobile carrier and plan. Wetherington Law Firm, P.C. does not charge for the SMS messages we send. SMS service is available on most major U.S. carriers, including AT&T, Verizon, T-Mobile, U.S. Cellular, Sprint, Boost, Cricket, MetroPCS, Google Fi, and most regional carriers. Carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and may be affected by factors outside the firm’s or the carrier’s control.

Opt-Out and Help Keywords

You can opt out of SMS communication from the firm at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message you receive from us. After you opt out, you will receive one final message confirming that you have been unsubscribed. We will not send you further SMS messages unless you re-enroll. Reply HELP, INFO, or AIDE to receive a message with the firm’s contact information. You may also contact us directly to opt out or for assistance:

SMS Privacy

The mobile number you provide is collected and stored as part of your client file. It is treated with the same care as other client contact information and is subject to the same attorney-client confidentiality and work-product protections that apply to your representation.

We do not sell, rent, lease, or share your mobile number or the content of any SMS communication with third parties or affiliates for marketing, promotional, or any other purpose. Mobile information is not shared with third parties or affiliates for marketing or promotional purposes. The only circumstances in which we share mobile data are: (a) with the SMS messaging platform we use to send and deliver text messages on our behalf, which is contractually bound to use that data only to provide the messaging service to us; (b) when required by law, court order, or subpoena; and (c) with your express written consent.

The content of SMS messages between the firm and a client may be subject to the attorney-client privilege and the work-product doctrine. We retain SMS communications as part of the client file for the duration required by applicable Georgia Bar rules and our records retention policy, and we apply reasonable administrative, technical, and physical safeguards to protect that information.

Eligibility

SMS communication from the firm is available only to current clients of Wetherington Law Firm, P.C. who have an active attorney-client relationship and who have provided prior express written or electronic consent. Mobile numbers belonging to non-clients, prospective clients who have not yet retained the firm, or individuals who have not provided consent will not receive SMS messages. If you receive a message from us in error, reply STOP and contact our office so we can correct our records.

Liability and Disclaimers

SMS text messages are not a substitute for legal advice and do not establish or modify an attorney-client relationship. Information sent by SMS is not encrypted end-to-end and may be intercepted in transit. Do not send confidential medical records, financial account numbers, government identification numbers, or other highly sensitive information by SMS. For sensitive communications, please use a phone call, our secure client portal, or email at the addresses provided in your representation agreement.

Wetherington Law Firm, P.C. is not responsible for delays in delivery, non-delivery, lost messages, or messages delivered to incorrect numbers caused by your mobile carrier, your device, signal availability, or other factors outside the firm’s reasonable control. To the fullest extent permitted by law, the firm disclaims liability for any indirect, incidental, consequential, special, or exemplary damages arising from your use of, or inability to use, SMS communication with the firm.

Changes to This Policy

We may update this page from time to time to reflect changes in our practices, applicable law, or the rules of the mobile carriers and messaging platforms we use. The “Last updated” date at the top of this page reflects the most recent revision. Material changes will be communicated to active clients in writing.
